Pre-construction in Mexico: how to protect your deposit
Updated · By Chase Jordan
The short answer
Before you pay a deposit on a pre-construction condo, see the land title, the construction permit, finished projects by the same developer, and a contract that ties payments to construction progress and says what happens if delivery is late. Nobody can promise appreciation or a delivery date.
8Checks before a deposit
The checklist
- Land title in the developer’s name, with a no-lien certificate
- Construction permit (licencia de construcción) and land-use permit
- Finished projects by the same developer that you can visit
- A payment schedule tied to construction progress, not just dates
- What happens to your money if delivery is late: penalties or refund terms in the contract
- Exact specifications and finishes attached to the contract
- The estimated HOA fee and what it covers
- How the deed is delivered at completion, and who pays closing costs
Frequently asked questions
Is pre-construction cheaper?
Often the price is lower and you choose your unit, but your money goes in before the building exists. That is the trade-off.
Can a delivery date be guaranteed?
No. Ask for written penalties or refund terms in the contract instead.
